According to this Decree, the subjects of environmental protection fee are industrial wastewater discharged into the water receiving sources as regulated by the law and domestic wastewater. The organizations, households and individuals discharging wastewater are the environmental protection fee payers for wastewater. In the case that the organizations, households and individuals discharge wastewater into the centralized wastewater treatment system and pay the wastewater treatment service fee to the centralized wastewater treatment system management and operation unit according to the service price mechanism, the centralized wastewater treatment system management and operation unit is the environmental protection fee payer for wastewater according to the regulations.

Specifically: The environmental protection fee rate for domestic wastewater is 10% of the selling price of 1 m³ of clean water excluding value added tax. In the case that it is necessary to apply a higher fee rate, the People’s Council of the provinces or cities directly under the Central Government decides the fee rate for each subject of fee. The environmental protection fee rate for industrial wastewater, facilities with total average annual wastewater volume under 20 m³/day (24 hours) applying the fixed fee calculated according to the wastewater volume in 2020 is 1,500,000 VND/year. From 01/01/2021 onwards, the average wastewater volume from 10 to under 20 m³/day is 4,000,000 VND/year; From 5 to under 10 m³/day is 3,000,000 VND/year and under 5 m³/day is 2,500,000 VND/year. For the production and processing facilities with total average annual wastewater volume of 20 m³/day or more: environmental protection fee = fixed fee rate + variable fee (“fixed fee” as for the facilities with total average annual wastewater under 20 m³/day, “variable charge” is calculated based on the total discharged wastewater volume, the content of pollution parameters of each substance contained in wastewater is specified in this Decree).

Cases of free environmental protection fee for wastewater include: Water discharged from the hydropower plants. Sea water discharged from the use to produce salt. Domestic wastewater of the organizations, households and individuals in the communes. The organizations, households and individuals in the wards, towns where have not had the clean water supply systems. The households and individuals who do not carry out business in the wards and towns where have had the clean water supply systems, self-exploit water for their own use. The cooling water without direct contact with pollutants, has its own outlet. The wastewater from naturally overflowed rainwater. The wastewater from the aquatic fishing means of fishermen. The wastewater of centralized wastewater treatment systems in the urban areas that has been treated and satisfied the technical standards and codes on environment according to the regulations before being discharged into the receiving sources.
